Surat Kepada TUHAN
Tuhan, perkenalkan, saya Sebastian Hutabarat, 49 Tahun, tinggal di Kota kecil Balige, tepian Danau Toba.
Bagi banyak orang, surat ini mungkin aneh, karena yang lazim dilakukan oleh banyak orang untuk berkomunikasi dengan Tuhan, adalah dengan berdoa dan beribadah, bukan dengan menulis surat.
Tuhan, beberapa minggu belakangan ini, saya kebingungan mendapat panggilan dari Polres Samosir, yang menyatakan saya sebagai tersangka dalam kasus penghinaan atau fitnah, dan dalam waktu yang juga sangat singkat, prosesnya begitu super cepat masuk ke Kejaksaan, dan berkasnya dinyatakan lengkap, P 21, dimana pada Hari ini, Kamis Tgl 16 Mei 2019 akan dilangsungkan sidang perdana dengan dakwaan penghinaan atau fitnah.
Sayapun bingung memfitnah dengan cara apa, siapa, dan dengan kata kata apa?
Berkali kali saya tanya penyidik Polres yang pernah datang berbincang bincang santai ke tempat kami di Balige, dan beberapa hari kemudian tiba tiba sudah menjadikan saya sebagai tersangka.
Saya tidak dapat penjelasan kenapa bisa dijadikan tersangka.
Barulah setelah didampingi pengacara, saya bisa sedikit mengerti akan beberapa pertanyaan menjebak dari penyidik Polres supaya mereka punya alasan menjadikan status saya menjadi tersangka, dan dengan cepat melimpahkannya ke Kejaksaan Negeri Samosir.
Setelah menerima sebagian fotocopy berkas berkas dokumen BAP, saya baru bisa melihat beberapa alasan yang dibuat oleh Polisi untuk menjadikan saya sebagai tersangka.
Tuhan…
Kasus ini berawal dari ketika saya dan sahabat saya Jhohanes Marbun, pengurus Yayayasan Pencinta Danau Toba (YPDT) Jakarta, saat mengunjungi teman kami Ratnauli Gultom, yang juga salah satu pengurus YPDT di Silimalombu Samosir, berjalan jalan disepanjang tepian pantai di Silimalombu, dan akhirnya tiba di tambang batu yang belakangan kami tahu milik Bapak Jautir Simbolon.
Kami mengakui tidak permisi kepada pihak pemilik atau sekurity karena memang kami tidak melihat tanda larangan, tidak melihat ada petugas yang menjaga dan banyak orang yang keluar masuk lokasi itu.
Saat memotret nelayan di pantai sekitar lokasi tambang, kamipun dipanggil oleh sekurity, dan dipertemukan dengan pemilik tambang Pak Jautir Simbolon.
Dalam diskusi bersama Pak Simbolon, kamipun bertanya siapa saja yang keberatan dengan kehadiran tambang tersebut?
Pak Jautir lalu bertanya kembali kepada Ingot Gultom siapa saja yang keberatan serta berkata berapa keluarga dari pihak Jaihutan yang keberatan?
Dalam diskusi tersebut, berkali kali Pak Jautir menjelaskan bahwa mereka punya izin yang lengkap perihal tambang mereka, padahal kami hanya bertanya apa saja keberatan masyarakat sekitar dengan kehadiran tambang batu itu?
Tuduhan ini jugalah yang kemudian dialamatkan Pak Jautir untuk menjadikan kami sebagai tersangka di Polres.
Membuat cerita baru bahwa kami datang dan tiba tiba bilang ijin tambang ini tidak jelas, sayapun bingung karena tidak pernah menyatakan pernyataan yang demikian.
Alasan kedua adalah, tuduhan bahwa kami menuduh tambang tersebut tidak disetujui warga sekitar, padahal kami hanya bertanya, siapa saja yang sebenarnya keberatan dengan kehadiran tambang batu itu?
Karena dalam diskusi itu, keadaan sedikit memanas, kamipun pamit untuk mengejar kapal Fery untuk menyebrang ke Parapat.
Akan tetapi tiba tiba, kami dikejar beberapa anggota Pak Jautir, dan dengan berteriak geram Pak Jautir memukul kepala teman saya Jhohanes Marbun yang setelah terjatuh, kemudian berhasil kabur mencari pertolongan.
Tangan saya dipegang beberapa orang, celana saya dipelorotkan, dan saya dibawa ke tempat kami berdiskusi semula.
Sayapun dipukuli berkali kali oleh Pak Jautir dan anak buahnya.
Anehnya walau dengan pengaduan bukti visum luka di bibir atas, baju yang berdarah, dan saksi yang melihat bagaimana saya dipukuli berkali kali oleh Pak Jautir dan anak buahnya, akan tetapi kasus itu bisa mandeg hingga satu setengah tahun di Kepolisian Samosir.
Baru setelah ada Bapak kejari yang baru, Pak Jautir ditahan dan kasusnya disidangkan, dan setelah beberapa kali bersidang, Pak Jautirpun divonis bersalah dengan hukuman dua bulan dan potong tahanan yang akhirnya juga segera bebas.
Kendati kami merasa ada ketidakadilan dan keanehan dengan penetapan pasal 170, tetapi hanya menghadirkan satu tersangka pelaku saja, padahal, sewaktu konfrontir dengan para pelaku, kami sudah mengatakan siapa saja anggota Pak Jautir yang memukul kami, kami lebih memilih menerima saja keadaan itu.
Karena kami percaya, hanya Tuhanlah yang merobah hati orang, bukan lamanya waktu di penjara yang akan membuat hati orang berobah.
Akan tetapi yang membuat kami kaget, beberapa hari kemudian, ketika Hakim memutuskan Pak Jautir bersalah, dengan proses yang sangat cepat, kamipun segera dijadikan tersangka dan akan diproses di pengadilan.
Tuhan…
Kami merasakan ada beberapa keganjilan dalam penetapan status tersangka ini, sehingga kami mengusulkan diadakannya gelar perkara di Polda Sumatera Utara agar terlihat jelas dan objektif proses fitnah yang dituduhkan kepada kami.
Akan tetapi pihak Poda menjawab perkara ini sudah pernah digelar di Polda, akan tetapi kami tidak diberitahu sama sekali.
Pihak Polres berdalih sudah mengirim surat pemberitahuan, akan tetapi bukti surat yang dimaksud dan pengirimannya pun kami tidak pernah lihat.
Beberapa hari setelah gelar perkara sepihak di Polda itu, sayapun dijadikan tersangka.
Sungguh keadaan ini sangat membingungkan kami.
Di foto copy BAP yang kemudian menjadikan saya sebagai tersangka, juga ada kesaksian Pak Bupati Samosir, setelah penyidik Polisi menanyakan kepada Pak Bupati Samosir, perihal tuduhan yang disampaikan Pak Jautir bahwa saya menuduh Pak Bupati Samosir punya saham 50 persen di PT Aquafarm.
Tuhan, sungguh aneh rasanya beberapa pertanyaan Polisi kepada Pak Bupati, hanya dengan tuduhan Pak Jautir yang kalimatnya tidak pernah keluar dari hati dan mulut saya.
Aneka fitnah yang disampaikan Pak Jautir, dengan beberapa pernyataan yang tidak pernah saya sampaikan, malah oleh Polisi dipakai untuk menjadikan saya sebagai tersangka dan digiring ke pengadilan.
Betapa semakin jahatnya dunia ini, dan tidak ada lagi rasa takut untuk menyampaikan aneka fitnah dan kebohongan.
Tuhan, sesuai ajaranMU agar kami belajar saling mengampuni, kami juga belajar untuk melakukannya.
Kami menemui Pak Jautir di rumahnya untuk meminta maaf kalau kalau dalam diskusi 15 Agustus 2017 dulu di pertambangan mereka, ada kata kata kami yang membuat beliau marah.
Juga kami menyatakan sudah memaafkan Pak Jautir dan semua anggotanya yang memukuli kami, dengan harapan kasus ini tidak harus dilanjutkan di pengadilan yang akan menyita waktu, pemikiran dan biaya yang cukup besar.
Akan tetapi Pak Jautir tetap dalam pendiriannya untuk tetap membawa kasus ini ke persidangan.
Tuhan…
Hari ini, Kamis 16 Mei 2019, akan menjadi sidang pertama kasus ini di Pengadilan Balige di Samosir.
Tuhan kiranya menjamah hati Jaksa, para pengacara, saksi dan kami semua agar kami berani mengatakan hal hal yang benar saja, dan menjauhkan aneka fitnah dan kebohongan.
Tuhan kiranya memberkati Pak Hakim yang akan menangani perkara ini agar berlaku adil dan bijaksana, sebagai gambaran Tuhan yang adil di bumi ini.
Tuhan, ajar kami untuk senantiasa setia dan sabar menerima semua cobaan dan fitnah ini.
Ajar kami untuk tetap berada di jalanMU, belajar memikul salib dan kuk yang Tuhan katakan akan enak dipakai.
Terima Kasih Tuhan, jadilah kehendakMU dan rencanaMU yang indah dan damai dalam kehidupan kami.
